1. Agreement to Terms

Welcome to Wallins! These Terms of Service ("Terms") govern your use of our mobile application Wallins ("App"), which provides AI-powered personalized wallpaper generation services ("Service"). These Terms apply to all users of the App.

By downloading, accessing, or using our App, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our App.

2. Description of Service

Wallins is a mobile application that provides:

• AI-Generated Wallpapers: Personalized wallpaper creation based on your preferences, mood, and style choices
• Automated Generation: Scheduled daily wallpaper creation at your preferred times
• Subscription Service: Premium features available through our Pro subscription plan
• Multi-language Support: Service available in multiple languages
• Push Notifications: Alerts when new wallpapers are ready

3. User Accounts and Registration

3.1 Anonymous Usage

Our App uses anonymous user identifiers instead of traditional account registration. We generate a unique, anonymous ID for your device to personalize your experience while protecting your privacy.

3.2 User Responsibility

You are responsible for:

• Maintaining the security of your device
• All activities that occur under your anonymous user ID
• Providing accurate information when using our questionnaire features
• Backing up any wallpapers you wish to keep permanently

3.3 Eligibility

You must be at least 13 years old to use our App. If you are under 18, you must have permission from a parent or guardian.

4. Subscription Terms and Billing

4.2 Billing and Payment

• Subscriptions are processed through Apple App Store or Google Play Store
• Payment is managed by RevenueCat and your platform's payment system
• Billing occurs at the beginning of each subscription period
• Prices are subject to change with notice

4.3 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends. You can manage your subscription through your device's App Store settings.

4.4 Cancellation and Refunds

• You can cancel your subscription at any time through your device settings
• Refunds are handled according to Apple App Store or Google Play Store policies
• You retain access to Pro features until the end of your current billing period
• No partial refunds for unused portions of subscription periods

5. AI-Generated Content and Intellectual Property

5.1 Content Generation

Our Service uses artificial intelligence to generate wallpapers based on your preferences. The AI creates original content, but:

• Generated content may inadvertently resemble existing works
• We cannot guarantee complete originality of all generated content
• AI-generated content may sometimes produce unexpected or imperfect results

5.2 User Rights to Generated Content

For wallpapers generated specifically for you:

• You have the right to use generated wallpapers for personal, non-commercial purposes
• You may share wallpapers on social media with attribution to Wallins
• You may not sell, license, or commercially distribute generated wallpapers
• You may not use generated content to train other AI models

5.3 Wallins Rights

We retain the right to:

• Use anonymized generation data to improve our AI models
• Display generated wallpapers in our marketing materials (with user consent)
• Remove or disable access to content that violates these Terms

5.4 Copyright and Trademark

The Wallins app, including its design, code, and algorithms, is protected by copyright and other intellectual property laws. You may not reverse engineer, modify, or create derivative works based on our App.

6. User Conduct and Prohibited Uses

6.1 Acceptable Use

You agree to use our Service only for lawful purposes and in accordance with these Terms.

6.2 Prohibited Activities

You may not:

• Attempt to reverse engineer or hack our AI systems

• Share your anonymous user ID or attempt to access others' accounts

• Circumvent our subscription or payment systems

When using our questionnaire and preference features, you agree not to input:

• Content that could generate inappropriate wallpapers

7. Privacy and Data Protection

8. Service Availability and Modifications

10. Disclaimers and Limitations of Liability

AI-generated content may:

• Inadvertently resemble existing content

10.3 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, regardless of the theory of liability.

Our total liability for any claims arising from or related to these Terms or our Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

12. Termination

You may stop using our Service at any time by deleting the App from your device and cancelling any active subscriptions.

We may terminate or suspend your access to our Service immediately, without prior notice, for:

• Violation of these Terms
• Fraudulent or abusive behavior
• Legal or regulatory requirements
• Technical or security reasons

12.3 Effect of Termination

Upon termination:

• Your right to use the Service ceases immediately
• Your subscription will be cancelled according to platform policies
• Generated wallpapers may be removed from our servers
• You should backup any content you wish to retain

13. Governing Law and Dispute Resolution

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wallins regarding the use of our Service and supersede all prior agreements and understandings.
